The Longshore and Harbor Workers' Compensation Act is a federal law that compensates injured maritime workers who are non-seamen and therefore do not qualify for the protections provided by the Jones Act. The law provides work-related-injury benefits to dock workers, repairmen, truck drivers, and others who work in loading, unloading, building, or repairing vessels.
If you are a longshoreman or other maritime worker who was injured on the job, the Longshore and Harbor Workers' Compensation Act does not require that you prove your employer was at fault for your injury. In this way, the law differs from the Jones Act and is similar to no-fault state workers' compensation laws. The Longshore and Harbor Workers' Compensation Act compensates injured workers for disability payments and rehabilitation services, as well as benefits paid to survivors of workers who are killed in work-related injuries.
The Longshore and Harbor Workers' Compensation Act provides work-related-injury benefits to about 500,000 American workers who are injured or contract occupational diseases while employed at jobs on the navigable waters of the United States.
Each year, the Longshore and Harbor Workers' Compensation Act provides more than $747 million in benefits to injured or killed workers. More than 27,000 cases are filed each year under the law, which maintains nearly $3 billion in securities, cash, and bonds to pay for worker benefits in cases where the employer goes bankrupt.
